Ticket terms

NOTE THAT THESE TERMS AND CONDITIONS LIMIT THE LIABILITY OF
GRIFFITH UNIVERSITY LAW STUDENTS’ ASSOCIATION INCORPORATED.
PLEASE READ THEM CAREFULLY AND FULLY.

Interpretation

  1. In these terms and conditions—
    alcohol-present event means an event at which alcohol is to be served or available for purchase.
    electronic ticket means a ticket that is either—
    an electronic form of a paper ticket that is viewable by the purchaser; or
    the recording by Griffith LSA of a person’s particulars allowing them access to an event, whether or not an electronic form of a paper ticket is provided or made viewable to the purchaser.
    Griffith LSA means the Griffith University Law Students’ Association Incorporated (IA57879), its employees, officers, agents and contractors.
    minor means a person under the age of 18.
    photographic identification means an adult proof of age card, driver license or passport issued by a government and, if the event is not an alcohol-present event, includes a student identification card issued by Griffith University.
    purchased includes tickets obtained gratis.
    responsible adult, for a minor, means a parent, step-parent or guardian of the minor or an adult who has parental rights and responsibilities for the minor.
    ticket includes an electronic ticket.
    venue means, if relevant, the place at which an event is held and includes, if relevant, the employees, officers, agents and contractors of any business or other enterprise that is operating in or at that place.

  2. Unless the contrary intention is expressed or implied, in these terms and conditions—

    1. headings (including those in italics at the beginning of paragraphs) are for convenience only and do not affect the interpretation of these terms and conditions;

    2. the singular includes the plural and vice versa;

    3. words that are gender neutral or gender specific include each gender;

    4. where a word or phrase is given a particular meaning, other parts of speech and grammatical forms of that word or phrase have corresponding meanings;

    5. no rule of construction applies to the disadvantage of a party because that party was responsible for the preparation of these terms and conditions or any part of it;

    6. the words “includes”, “including” or “such as” are not words of limitation, and when introducing an example, do not limit the meaning of the words to which the example relates to examples of a similar kind.

  3. Multiple readings: If any provision or part of a provision of these terms and conditions can be read in a way that makes the provision illegal, unenforceable or invalid, but can also be read in a way that makes the provision legal, enforceable and valid, the provision must be read in the latter way.

  4. Severance: If any provision of these terms and conditions is prohibited by law or judged by a court to be unlawful, void or unenforceable, the provision shall, to the extent required, be severed from these terms and conditions and rendered ineffective as far as possible without modifying the remaining provisions of these terms and conditions, and shall not in any way affect any other circumstances of or the validity or enforcement of these terms and conditions.

  5. Modification: Griffith LSA reserves the right to make amendments to these terms and conditions from time to time at the sole discretion of Griffith LSA and without notice. A full copy of the latest version of these terms and conditions (as amended, if appropriate) is available at griffithlsa.org.au/tickets and upon request, in writing from Griffith LSA.

  6. Any information requests or other correspondence in relation to these terms and conditions must be addressed—

Any written requests made by post are subject to the postal rules outlined in these terms and conditions.

Ticket Purchases

  1. Tickets limited: Ticket sales may be limited to a specified number of tickets. Griffith LSA may cancel or refuse to accept orders that it believes are placed in excess of any such limits with a full refund of any value tendered in respect of the order less reasonable administration costs.

  2. Non-refundable: Once purchased, your ticket and any transaction fee will not be refunded or exchanged, except as required by law.

  3. Non-exchangeable: If this ticket entitles you to one or more complimentary items, the ticket is not exchangeable for cash, whether in full or in part, including where one or more items is not redeemed in full or in part.

  4. Incorrect pricing: If the amount you pay for your ticket is incorrect (regardless of whether the error arose due to an advertising error online or otherwise communicated to you, human error or a technical malfunction), Griffith LSA may cancel the ticket and refund to you the amount that you paid and may offer a replacement ticket to you at the correct price.

  5. Wrong type: If the amount you pay for your ticket is incorrect because you did not meet the listed requirements for that ticket at the time of purchase, Griffith LSA may cancel the ticket and refund to you the amount that you paid and may offer a replacement ticket to you at the correct price.

Example for provision 5—
Nancy is not a member of Griffith LSA but purchases a member-discounted ticket. Griffith LSA may cancel Nancy’s ticket.

Conditions of Entry and Continued Presence

  1. Production of photographic identification: Griffith LSA may, prior to admitting you to the event, require you to allow Griffith LSA to inspect your photographic identification to prove that you are allowed admittance to the event.

  2. Griffith LSA may, notwithstanding your purchase of a ticket, in its discretion refuse your entry to the event or require you to leave the area or place at which the event is or will be occurring if—

    1. Griffith LSA cannot ascertain your identification to determine whether you in fact hold a ticket; or

    2. the name displayed on, or registered to, your ticket does not match the name on your photographic identification; or

    3. in the opinion of Griffith LSA, you are unduly intoxicated or acting in a disorderly manner; or

    4. in the opinion of Griffith LSA, you are acting in an obnoxious manner; or

    5. the event is an alcohol-present event, you are under the age of 18 or you fail to provide your photographic identification and you are not accompanied by a responsible adult or an adult who is not affected by an intoxicating substance.

  3. Notwithstanding any other provision under these terms and conditions, you agree to be bound by any additional conditions of entry that a venue may wish to impose (“Venue Conditions”) and that these Venue Conditions are incorporated into these terms and conditions, provided that those Venue Conditions are communicated to you at or prior to the time you agree to these terms and conditions.

  4. If you are in breach of any of the Venue Conditions, the venue or Griffith LSA may, notwithstanding your purchase of a ticket, in the discretion of the venue or Griffith LSA refuse your entry to the event or require you to leave the area or place at which the event is or will be occurring.

  5. If you are refused entry or required to leave under this division, to the extent permitted by law your ticket is not refundable.

Touting

  1. Tickets must not be resold or offered for resale at a premium or packaged, resold or otherwise offered for advertising, promotional or other commercial purposes (including competitions) without prior written consent from Griffith LSA.

  2. If a ticket is sold or used in contravention of this condition, Griffith LSA may seize, cancel without refund or exchange the ticket and deny the bearer of the ticket admission to the event.

  3. If a ticket is resold to another person at the same or a lower price than it was originally purchased for, the original purchaser must inform Griffith LSA of the sale otherwise the ticket will remain the property of the original purchaser and will be unusable by the person to whom it was resold.

Image Release

  1. I agree to Griffith LSA making images or recordings, whether sound, digital or otherwise, of me (“Images and Recordings”).

  2. I agree to Griffith LSA—

    1. using, publishing or reproducing the Images and Recordings in any form (in whole or in part) and by any medium, including third party social media websites, newspapers, magazines, brochures, television advertisements, promotional videos, websites or other multi-media for public relations, promotions, commercial and advertising purposes (“Promotional Materials”); and

    2. retaining or storing the Images and Recordings (including those incorporated into Promotional Materials) in hard copy or digitally.

  3. I agree that the rights granted to Griffith LSA under this division are perpetual and that I will not receive any payment, royalty or other consideration (whether monetary or otherwise) from Griffith LSA in connection with the making, use or storage of the Images and Recordings.

  4. I agree to Griffith LSA collecting, storing, handling, accessing, managing, transferring, using and disclosing personal information about me including my name, details and image, in connection with the Images and Recordings or the Promotional Materials.

  5. I acknowledge and agree that any Promotional Materials that refer to me, expressly or by implication, are, at the date of publication, made in good faith and are not intended to defame or offend me or bring me into disrepute.

  6. I agree that Griffith LSA is the owner of the copyright in the Images and Recordings and the physical Images and Recordings.

Limitation of Liability

  1. TO THE EXTENT PERMITTED BY LAW, GRIFFITH LSA IS NOT LIABLE TO YOU FOR ANY LOSS, DAMAGE, INJURY, DELAYS, ADDITIONAL EXPENSES OR INCONVENIENCE ARISING AS A RESULT OF YOUR ATTENDANCE OR NON-ATTENDANCE AT THE VENUE AND/OR THE EVENT.

  2. Where liability cannot be excluded or modified by law, the liability of Griffith LSA is limited to the minimum permitted by law.

Limitation of Waiver

A FAILURE BY GRIFFITH LSA TO TAKE ACTION TO ENFORCE ITS RIGHTS DOES NOT CONSTITUTE A WAIVER OF ANY RIGHT OR REMEDY UNDER THIS AGREEMENT UNLESS IT IS IN WRITING SIGNED BY GRIFFITH LSA.

Authority

  1. If purchasing a ticket or multiple tickets for a third party or multiple other third parties, you warrant that you have authority to bind the party or parties that you state to represent to these terms and conditions.

  2. You warrant that you have the authority to make payment for your ticket and that you own/hold or have express permission of the owner/holder of the credit card or other payment facility used to purchase the ticket.

Breach

Any breach of these terms and conditions may, in addition to any other remedy that Griffith LSA may have, result in the cancellation of the ticket, the refusal of admission of the bearer of a ticket to the venue, or the bearer’s eviction from the venue, in each case without refund or compensation.

Entire agreement

  1. These terms and conditions form the entire agreement between the parties and supersede all and any communications, negotiations, arrangements and agreements, whether oral or written, between the parties in respect of the matters that are the subject of these terms and conditions.

  2. To remove any doubt—

    1. this provision does not extend to claims that cannot be excluded by law; and

    2. does not act to exclude any Venue Conditions from the agreement between the parties.

Governing law

  1. Applicable law: These terms and conditions are governed by, and construed and interpreted, in accordance with the laws of the state of Queensland, Australia.

  2. Jurisdiction: The parties irrevocably submit to the exclusive jurisdiction of the courts of the state of Queensland, Australia, including any Federal Court of Australia registry within the state of Queensland.

Indemnification

  1. You agree to indemnify Griffith LSA for the loss or destruction of, or any damage to, the venue property to the full value of any of the same done or caused or directed to be done by you.

  2. You agree to indemnify Griffith LSA for any loss resulting from any act that is illegal or offensive, or is in breach of any statutes, by-laws, orders, regulations or other provisions having the force of the law.
